| 3 | | The Federal Aviation Administration is seeking an end to the regulatory loophole that enables non-ATP commercial pilots to operate passenger flights. Per the General Operating and Flight Rules, a Part 135 charter flight may operate as a commercial flight if the advanced bookings do not surpass more than 30 passenger seats. More: - The rule is said to be misused by commercial airlines by contracting charters to offer regularly scheduled services.
- Pilots qualified for Part 135 flights require a minimum of 250 flight hours rather than the ATP and 1,500 hours for Part 121 requirement for regularly scheduled flights.
- "Were FAA to amend its regulatory framework, some operators conducting public charter operations would need to transition from operating under Part 135 to Part 121," reads the agency's notice of intent.
