THE DREAM CONTINUES — Voters in a key border state will soon weigh a major reversal of local anti-immigrant policy.

— Undocumented Arizona high school graduates can receive in-state university and community college tuition if Proposition 308 wins approval in November. Fired-up Latino organizers and prominent business interests back the measure. A handful of Republicans helped push the initiative onto the state's action-packed midterm ballot. A lifelong conservative even chairs supporters' well-funded political action committee.

— But Yes on 308 promoters face entrenched opposition from voters who are incensed about the border crisis and see immigration as a top issue in the election. Arizona's conservative politics boast a deep record of hostility toward undocumented migrants, including young people and students brought into the United States as children who are often known as Dreamers.

— Tyler Montague , a Republican strategist and chairman of Yes on 308, still hopes a winning vote tells Arizona Democratic Sens. Kyrsten Sinema and Mark Kelly (should he survive this fall's election) they can support immigration reforms that have so far failed to launch in Washington.

— "Arizona is viewed as being at the center of anti-immigrant rhetoric and dialogue," Montague told your host. "But this is a broad, nonpartisan coalition of people. We all agree there's an obvious problem here that we could solve together. I mean, wow, who does that?"

— "We hope that's a good thing," Montague added. "And that lawmakers at the federal level — particularly Sinema, and Kelly, if he wins — will see this and say, 'There's support in my home state for sensible reforms to immigration problems, and I don't need to live in absolute terror that if I support something sensible I'm going to be punished for it at the ballot box.'"

IT'S TUESDAY, OCT. 11. WELCOME TO WEEKLY EDUCATION. Federal Reserve Chairman Jerome Powell is applying the brakes to the U.S. economy harder than any Fed chief in more than 40 years in order to kill raging inflation. Yet, while a recent survey shows Americans are evenly divided over his efforts, there's been little public criticism among Democrats in Congress.

A message by the American Heart Association:

When will the U.S. Senate act on child nutrition? School meals are a recipe for student success. But the Senate's inaction is a recipe for disaster. Millions of kids no longer have access to healthy school meals at no cost all while soaring food prices cause major hardships for families across the country. Tell your Senators: Act now to ensure every child can get healthy school meals for free.

RESISTING THE RHETORIC — Yes on 308 is deploying a multimillion-dollar television advertising campaign in Arizona's biggest markets as part of its get-out-the-vote effort, armed with messaging research and internal polling that shows a consistent base of support among voters such as Democrats, college graduates and people under the age of 50.

— Yet Prop. 308's supporters need a share of persuadable independent and Republican voters to win, and they'll have to outmatch the words of American conservatism's leading political figure.

— "Your border has been completely obliterated," former President Donald Trump intoned to rally-goers gathered near Phoenix on Sunday. "Millions and millions of illegal aliens are coming unvetted and unchecked into your communities."

— Democrats will "flood the country with tens of millions more illegal aliens," Trump continued. "They'll ram 'em through and they'll ram through things like mass amnesty. They want to give illegal aliens welfare — more welfare than American citizens get, more help than we give to our great veterans."

— That type of hard-line anti-illegal-immigration rhetoric prompted Arizona voters in 2006 to overwhelmingly approve sweeping prohibitions that barred undocumented migrants from accessing public assistance programs, including in-state tuition and financial aid.

— Arizona is one of three states that prohibit in-state tuition for undocumented students, according to a 2021 analysis from the National Conference of State Legislatures. Two other states do not allow undocumented students to enroll at any public postsecondary institution.

— More than 20 states and the District of Columbia, meanwhile, have laws or policies that allow undocumented students to pay in-state tuition at public colleges and universities, according to the National Immigration Law Center.

— Supporters of the Arizona repeal are making a moral and economic case to voters to join that list: They have sought to portray affected students as Arizonans who can help build out the state's workforce after coming to the U.S. through no choice of their own, attending the same schools, and meeting the same requirements for in-state tuition as their classmates. Montague said an estimated 2,000 to 4,000 students in each year's high school graduating class would benefit.

— "Whatever your frustrations are with illegal immigration, this isn't one of the negative outcomes," Montague argued. "If you're frustrated about drugs and gangs and human smuggling — those are problems, but this is not. Once you know some of these people personally, the arguments that they're terrible people ruining our country don't mesh with the reality of personal experience."

GUNS ON THE BALLOT — President Joe Biden and allied Democrats are ramping up a message on gun regulations that is linked to school shootings ahead of November's midterms.

— Prompted by renewed parent and voter concerns following May's attack at Robb Elementary in Uvalde, Texas, political groups are deploying gun-driven television advertising against Republican candidates in states including Colorado, Texas and Wisconsin. The Everytown for Gun Safety Action Fund last week endorsed dozens of local political candidates. Biden is also promising an assault weapons ban in the unlikely event his party wins control of both congressional chambers this fall.

— "Gun safety for our kids and gun violence are on the ballot," Biden said in September during a speech to roughly 300 people at the National Education Association's headquarters in Washington.

— "The idea that you start school this year and kids in many parts of the country are learning how to duck and cover … rather than talking about reading, writing and arithmetic is a very different type of circumstance. It's not right. It's not who we are. It's not who we should be," the president said.

— Giffords PAC, the gun control super PAC associated with former Rep. Gabby Giffords, is behind a $2.5 million Colorado ad blitz centered on school shootings that opposes construction entrepreneur Joe O'Dea's bid to unseat incumbent Democratic Sen. Michael Bennet.

— "We've had so many school shootings," a Denver-area mother says in one 30-second spot. "Joe O'Dea doesn't care about the safety of my kids when they're in school. He's on the side of the gun lobby."

— A Texas advertisement from Beto O'Rourke's gubernatorial campaign features Ana Rodriguez, the mother of one of Robb Elementary's victims, saying Republican Gov. "Greg Abbott has done nothing to stop the next shooting. No laws passed. Nothing to keep kids safe in school."

— "They're scared to death to go back to school," Biden said last week of school shooting victims and their families during a Democratic National Committee reception in New Jersey. "The psychological damage done to these kids is just serious."

— "I promise you," Biden added, "If we maintain control — you may not like it — but we're going to eliminate assault weapons again."

In the Courts

ANOTHER DAY, ANOTHER LAWSUIT — A small-business advocacy group has filed a new lawsuit seeking to block the Biden administration's efforts to forgive student loan debt for tens of millions of Americans — marking the latest legal challenge to the program, The Associated Press reports.

— The suit, filed Monday by the Job Creators Network Foundation, argues the Biden administration violated federal procedures by failing to seek public input on the program. It's one of a handful of lawsuits that have been filed by conservative business groups, attorneys and Republican lawmakers in recent weeks as the Biden administration tries to push forward with its plan to cancel billions in debt before November's midterm elections.

— Elaine Parker, president of Job Creators Network Foundation, slammed the program as executive overreach and complained that it does nothing to address the root cause of rising debt: the "outrageous increase in college tuition that outpaces inflation every single year."

— The lawsuit , filed in the U.S. District Court for the Northern District of Texas against the Education Department and Secretary Miguel Cardona, alleges the Biden administration violated the Administrative Procedure Act's notice-and-comment procedures. It also challenges the administration's legal justification for the program.

Title IX

POLITICS OF SPORT — Republicans are building women's sports into a pillar of the party's midterm strategy just as the Biden administration's window to tackle the issue steadily shrinks, Bianca reports.

— House Minority Leader Kevin McCarthy's new GOP policy agenda declares "only women can compete in women's sports." Kentucky Sen. Rand Paul and Georgia Senate hopeful Herschel Walker have both campaigned with an outspoken college swimmer who says she shouldn't have to compete against transgender women. And in Kansas, the Republican Governors Association has run ads attacking Democratic Gov. Laura Kelly after she vetoed restrictions on transgender student athletes.

— While the GOP digs in over gender identity and sports on the campaign trail, Democrats — desperate to retain control of Congress — are largely silent. As the November election approaches, pressure mounts on the Education Department to propose a rule establishing explicit protections for transgender athletes to play on teams that match their gender identity.

— The Education Department has two options: Push out a rule that's likely to put campaigning Democrats on the defensive, or risk giving a Republican-controlled Congress more time to reverse the rule — and prevent anything "substantially similar."

A message by the American Heart Association:

When will the U.S. Senate act on child nutrition?

School meals are a recipe for student success. Since early 2020, every child in America has been eligible for school meals at no cost, regardless of family income level - no forms, no questions asked. The policy has kept millions of children and families from going hungry during the pandemic. But that support has ended just as the new school year has started. The Senate's inaction is a recipe for disaster, as millions of kids lose access to healthy school meals at no cost while food prices soar.

Tell your Senators: Act now to ensure every child can get healthy school meals for free.
